We live in a world of uncertainty, add in cannabis and the uncertainty of the new administration's policies, and that uncertainty is MASSIVE. In an earlier post, we discussed our worry of what could happen with Trump's policy on cannabis. Here are a few facts before we dive into our analysis: It's Illegal and we're protected just by a few memos that can be wiped away. As of February 2017, 42 states have some form a cannabis legalization in place. 30 states have legalized medical medical marijuana, 8 states and D.C. have legalized the adult use of marijuana, and many more (13) have at least some type of cannabidiol law in place. Cannabis is a schedule 1 drug under the Controlled Substance Act and is FEDERALLY illegal. We are all aiding and abetting in a federal crime, despite it being legal in more than half of the United States. The DOJ announced in 2013 it would not directly challenge state marijuana legalization laws and would tone down enforcement of federal laws against pot sales in states allowing the practice. (Cole Memo). This is after massive years of DEA raids and the cannabis eradication programs. The Rohrabacher-Farr Amendment also has protected the thriving medical marijuana program (including Puerto Rico and Guam). It's not Killing Anyone, and actually looks like some good is coming out of it Tax revenues in adult use states are massive (Oregon reported over $60Million in taxes its first year of licensing) Studies have suggested that cannabis is a tool to help fight the massive opioid addiction in the United States. Drugged driving, deaths, and other scare tactics as it relates to cannabis have yet to be discovered with the legalization of marijuana. Public safety remains a huge issue for the cannabis community as it relates to being an all cash business The industry is still very young, and there is clearly much more work to be done with respect to cannabis regulation. What the TRUMP? We wrote about it here, but Trump has said he thinks it is a states right issue. He has leaned more towards medical than adult use. We know Sessions (Attorney General) is a critical, and we just learned that Sean Spicer's wifey is the senior vice president of National Beer Wholesalers Association, which represents the interests of beer distributors.  On February 23, 2017 in a press conference, Sean Spicer, elaborated on the administrations' stance on cannabis, with a clear stance that recreational marijuana is clearly different than medical marijuana. Even in regulated states such as Oregon, the current testing requirements are only now shining a light on the residual pesticides leftover in cannabis products - and it is significant.  Currently over 25% of concentrates and extracts are failing testing requirements for pesticides in Oregon. The prevalence of these toxic chemicals should require that regulation be tighter on cannabis operators, as this is a matter of public safety. However, recent proposed regulation in Oregon, is actually trying to loosen the rules on lab testing requirements. As a matter of public safety, this regulation must not pass.

Despite being legal in more than half the states of the US, cannabis, and hemp are still federally illegal and considered to have no medical benefit by the US government and listed as a Schedule 1 substance under the Controlled Substance Act. As it stands, farmers face several barriers to grow cannabis and hemp due to federal prohibition — including restricted access to banking, water rights, and crop insurance.

1619-1996 Cannabis History

This history of hemp and cannabis is incredible and dates back to 1619 with our founding fathers. 

In 1850, cannabis was added to US Pharmacopeia as a treatment for numerous afflictions, including tetanus, alcoholism, opiate addiction, anthrax, gout, convulsive disorders, excessive menstrual bleeding, among others.  

In 1933 alcohol prohibition ends, and "cannabis concerns" arise at the US Federal level. In 1934, The Garrison Act passed, which outlawed cannabis among other drugs. In 1936, medical Marijuana is replaced by other pain relievers and is removed on the US Pharmacopeia in 1937.

From the 1950s-1980s, cannabis is listed as a controlled substance and the US implements very strict mandatory minimum sentences for cannabis possession. 

In 1996, California was the first state to legalize medical marijuana under prop 215. In 2014, Colorado was the first state to legalize adult use of cannabis. To date, more than 30 states have legalized cannabis. 

April 2018 Cannabis Updates that make me think federal legalization is on the horizon (3-5 years)  

Last week was a historic week for the Cannabis, Hemp and CBD Industries.  

On April 11, Former House speaker John BANER, a longtime opponent of cannabis legalization, announced that he will serve on the board of advisers for a cannabis company- Acreage Holdings - that has licensed cannabis facilities in the United States.

On April 13, Mitch McConnell introduces Hemp Bill in the Senate.  The bill would not legalize marijuana for recreational or medical uses but would allow non-psychoactive forms of cannabis.

Last week, Sen. Cory Gardner, from Colorado, announced that President Donald Trump had committed to him that the Department of Justice's rescission of the Cole Memo, which protected states with legal marijuana from federal intrusion in their legal industries, would not impact Colorado's legal marijuana industry. "Furthermore," Gardner wrote in a press release, "President Trump has assured me that he will support a federalism-based legislative solution to fix this states' rights issue once and for all.

Then add on top of this, the FDA is sending out a request for comment that is due on April 23 on the potential de-scheduling of cannabis.

In December 2017 the UN’s World Health Organization said that CBD should not be scheduled as a controlled substance, an initial finding that comes about a month after the agency reviewed cannabidiol therapies.  

We will hear the World Health Organization’s stance on cannabis and cannabis resin, extracts, and tinctures of cannabis in June when they issue their decision.  

If the feds are thinking about decriminalization of cannabis in the US, this process would not happen overnight. That being said, it is critical that we vocalize the benefits of cannabis as well as the lack of abuse.

How often do you wonder, what are the active ingredients in this delightful meal I’m having? For many Americans, knowing what is in the food or medicine we are consuming is a huge component of our purchasing decisions. Whether it’s gluten-free or non-GMO, to 100mg of Vitamin C - packaging and labeling are huge components of our consumer needs.

There are a number of agencies that are tasked with regulating packaging at the federal level. The Food & Drug Administration regulates food and drugs, the US Department of Agriculture regulates agriculture, meat, and poultry, the Alcohol, Tobacco Tax & Trade Bureau regulates Wine, Malt Beverages, Distilled Spirits.

And so, the question many of you might have, is who regulates cannabis packaging? The answer is pretty simple until it is federally legal,  the states regulate cannabis packaging.

Cannabis packaging requirements vary by state to state, although there are definitely some common nuances to each state. For example, some requirements include:

clearly labeling all products as a cannabis or marijuana product and making sure that the active ingredients THC, CBD, or other cannabinoids are included on the label

Ensuring that the packaging cannot be attractive to children,

A warning label that might say, GOVERNMENT WARNING: THIS PRODUCT CONTAINS CANNABIS, A SCHEDULE I CONTROLLED SUBSTANCE.  

One lesson I’ve learned while working in the cannabis space is that regulation and business doesn’t necessarily see eye to eye. Last year in the state of Oregon, Cannabis operators were required to go through several hurdles and changes as it related to packaging their cannabis products. The result - time and money wasted.
